not approach the Pofts occupied by the French Troops.

Art. XII. All Alienations, or Sales of moveable or immoveable Property whatever, by the French Government while in Poffeffion of Malta, and all Tranfactions between Individuals, fhall be held inviolable.

Anfwer. Granted; as far as they fhall be juft and lawful.

Art. XIII. The Agents of the Powers, Allies to the French, who fhall be in Valette at the Reduction of the Place, fhall not be molefted in their Perfons or Property, but fhall be guaranteed by this Capitulation.

Anfwer. Granted.

Art. XIV. Ships of War, or Trading Veffels coming from France under the National Flag, and prefenting themselves at the Harbour to enter, fhall not be confidered as Prizes, nor fhall their Crews be made Prifoners, for the first Twenty Days after the Date of the prefent Capitulation, but fhall be fent back to France with Convoy.

Art. XV. The General in Chief and the other Generals fhall be embarked with their Aides-deCamp and the Officers attached to them, as well as the Ordonnateurs and their Suits refpectively, who fhall not be separated.

Art. XVI. The Prifoners taken during the Siege, including the Crews of the Ship Le Guillaume Tell, and the Frigate La Diane, fhall be restored, and treated as the Garrison; alfo the Crew of the Frigate La Juftice, if fhe fhould be taken on her Voyage to any of the Ports of the Republic.

Anfwer.-The Crew of Le Guillaume Tell are already exchanged, and that of La Diane fhall be tranfported

transported to Minorca, to be exchanged forthwith.

Art. XVII. Every Perfon in the Service of the Republic fhall be exempt from any Act of Reprifal whatever, or under whatever Pretext.

Anfwer.-Granted.

Art. XVIII. If any Doubt fhall arife upon the Terms of this Capitulation, it fhall be interpreted in Favour of the Garrison.

Anfwer. Granted, according to Juftice.

Efq; dated off St. Paul's, the 5th September 1800.

A

S my Lord Keith is now at Mahon, and it may be fome Time before he has an Opportunity of communicating with their Lordships, I have the Honor to enclose a Copy of my Letter to his Lordship, giving an Account of the Surrender of the French Garrison of La Valette, and one of the 29th Auguft, acquainting him of the Capture of La Diane French Frigate.

HAVE the Honor to acquaint you, that the French Garrison of La Vallette furrendered yefterday to the Allied Forces ferving at Malta, and to enclofe a Copy of the Articles of Capitulation *.

I have not yet been able to obtain an Account of the Ordnance and Stores in the Garrifon; the Moment it can be procured I will tranfmit it to your Lordship.

1 enclose a Lift of the Ships and Vessels found in the Harbour.

I HAVE the Honor to acquaint you, that the Frigates La Juftice and La Diane failed from the Harbour of La Valette,on the Night of the 24th, and were immediately purfued by His Majefty's Ships off that Port; and that the latter, after a

Chace of fome Hours, and a running Fight with the Succefs, ftruck to that Ship, the Genereux, and Northumberland. La Juftice, I am forry to add, escaped under Cover of the Night, and has not fince been heard of.

La Diane mounts Forty-two Guns, Eighteen and Nine Pounders, but had only One Hundred and Fourteen Men on board, having left the Remainder to affift in the Defence of the Garrison.

Y Letter of the 11th Inftant will have ac

M'quainted their Lordships of my having formed

the Refolution of attempting an Enterprize against Two Armed Veffels, reported to be receiving Stores in the Roads of Barcelona for the Relief of Malta. I have now the Satisfaction of informing you, that this Service has been very judicioufly arranged by Captain Louis of the Minotaur, and moft gallantly and fuccefsfully executed by Captain Hillyer of the Niger, and Lieutenant Schomberg of the Minotaur, in the Boats of thefe Ships, as will appear by the Report made to me thereon by Captain Louis, a Copy of which is herewith enclosed. I have no Doubt that their Lordships will justly appreciate the Merits of the Officers by whom this gallant and enterprifing Service has been performed.

Minotaur, Sept. 6, 1800. NOWING how anxious and defirous your

K Lordship was, as well as the Service to my

Country, by cutting out or deftroying the Two Corvettes, lying in Barcelona Road, mentioned in your Lordship's Orders to Captain Oliver; and, in order to check the Two Ships failing upon this intended fecret Expedition, induced me to perfevere in the following Attempt:

On the Evening of the 3d Inftant, after having delivered Captain Hillyer of the Niger his Orders to join your Lordship, a Breeze fprung up from the Weftwar', with every Appearance of a close Night. I again called him on board, with the Signal at the fame Time to prepare Boats. Captain Hillyer and Lieutenant Schomberg volunteered the Service, affifted by Lieutenants Warrand, Lowry, Lieutenant Healy of the Niger, Mr. Reid, Mafter, and Lieutenant Jewell of the Marines. The Boats left the Minotaur about Eight o Clock in the Evening. The Firing began from all Quarters near Nine: about Ten o'Clock I had the pleafing Satisfaction to fee Two Ships dropping out of the Road under a heavy Fire from the Ships, Four ftrong Batteries, Ten Gun-boats, Two Schooners, with Two Forty-two Pounders each-the Fort of Mount Joui the fame Time throwing Shells.-The Minotaur and Niger were well placed in good Season to cover the Party. The Service was performed throughout with an enterprifing Spirit, good Conduct, and in a gallant Stile. The Lofs, which I fhall inform your Lordship, of Killed and Wounded fell principally upon Two Boats, not great, when compared to the Situation the Number of Boats and fo many Men were placed in for a confiderable Time. The Ships about Eleven o'Clock were perfectly clear from the Fire of the Enemy's Batteries and Gun-Boats, the Men of War checking the Movements
